Terms of Use Agreement - FOTO KARELIA OY's online photo service
1.Introduction
Welcome to FOTO KARELIAN OY's online photo service, which is offered to you by FOTO KARELIA OY. These terms of use apply to your use of FOTO KARELIA OY's photo service. By clicking the "I accept the terms of use" button, you accept these terms and conditions, which form a binding agreement between you and FOTO KARELIA OY. It is therefore important that you read these terms carefully first.
2.Trademark and copyright
FOTO KARELIA OY and related graphics, logos and service names are trademarks of FOTO KARELIA OY. Third-party trademarks associated with the use of this Service are the property of their respective owners. You are not authorized to use any trademark associated with any product or service without the express permission of the trademark owner. You are deemed to understand that all content and other works made available to you through the Service (hereinafter collectively referred to as the "Content") are protected by copyright or other proprietary rights. You are not authorized to reproduce, modify, decompile, disassemble, distribute or display any Content without the express permission of the Content owner.
3.Your copyright
FOTO KARELIA OY respects the copyrights of others. If you believe that this service has infringed your copyrights, please contact FOTO KARELIA OY. Upon receipt of your request, FOTO KARELIA OY may remove the Content that you believe infringes your copyrights. In addition, FOTO KARELIA OY may terminate the account of the user who has infringed your copyrights.
4.User responsibilities
Illegal, inappropriate or unethical activity or content, as well as the matters listed below, will constitute grounds for blocking your access to our service, removing existing material and not fulfilling your order. As a condition of using this service, you will not:
a) send or transmit to the service in any way any Content that is unlawful, harmful, threatening, harassing, defamatory, obscene, inappropriate, invasive of privacy, objectionable or otherwise objectionable;
b) send or transmit to the service in any way any Content that you do not have the right to transmit
c)causes any kind of damage
d)forge headers or otherwise manipulate identifiers to disguise the original Content transmitted through this service;
e) send or transmit to the service in any way any material that contains viruses or other computer code, files or programs designed to interrupt, destroy or limit the functionality of any software
f) interfere with (or attempt to interfere with) this site or any servers or networks connected to this site, or fail to comply with any requirements, functions, policies or rules relating to these sites;
g)incites illegality, the use of offensive language or images, obscenity or pornography, or any other material that could give rise to civil or criminal liability or violate any law or regulation.
5.Content monitoring
FOTO KARELIA OY does not review the content of users' files and has no obligation to do so. The content of any material submitted by a user is the sole responsibility of that user, not FOTO KARELIA OY.
6.Warranty clause
This website and all FOTO KARELIA OY products and services are provided and are available as is without warranty of any kind. FOTO KARELIA OY disclaims all warranties and responsibilities regarding the security, reliability, suitability and performance of the service.
As a user, you understand and agree that the transfer of digital images or any other material to FOTO KARELIA OY or through its service, as well as the downloading and use of the software, is at your own discretion and risk, and that you alone are responsible for any damage to your computer or images or any loss or corruption of data or files. Therefore, it is your responsibility to make backup copies.
FOTO KARELIA OY is not liable to anyone for any direct or indirect damage, even if FOTO KARELIA OY has been notified of the possibility of such damage.
8. Applicable legislation
All disputes and legal cases related to the use of this service will be resolved in a Finnish court in accordance with Finnish law.
9. Payment service terms
Payment service provider
Paytrail Oyj (2122839-7) operates as a payment intermediary and payment service provider in cooperation with Finnish banks and credit institutions. Paytrail Oyj appears as the recipient of the payment on the bank statement or card invoice and forwards the payment to the merchant. Paytrail Oyj has a payment institution license. In cases of complaints, we ask you to primarily contact the product supplier.

Walley Invoice/Installment Payment
Flexibility and freedom of choice – pay all at once or in installments, at your own pace
Invoices and overdrafts give you more time to pay for your online purchases. Using them, you can wait for your order to arrive before paying for it. You can pay either all at once with an invoice or in smaller installments with an overdraft, allowing you to pay the amount that suits you best each month and spread the payment over a maximum of 36 months.
Free payment time with invoice – safe and easy transactions
With an invoice, you always get 45 days of interest-free payment for your online purchases. The long payment period allows you to check your purchase and, if necessary, return it before the invoice is due.
To take advantage of the payment period, you need a positive credit decision, which can be easily applied for in connection with the purchase transaction. You can apply for it if you are at least 18 years old and have a Finnish personal identity code and a permanent, official home address in Finland. Your credit information will also be checked from the Bisnode Finland Oy register.
The payment method can be used for purchases of up to €5,000.
Once you have received a positive credit decision and confirmed the purchase, you will receive an invoice for your purchase by email. If you want to pay the invoice in smaller installments and with a payment term that suits you better (1-36 months), you must make a credit agreement for continuous credit with Collector Bank AB by logging into My Pages at my.walley.fi . When signing the credit agreement, you will be granted a credit limit that can be used for subsequent purchases in accordance with the credit terms.
When you have a valid credit agreement, you only have to pay the minimum amount stated on the invoice you receive by the due date, but you can also pay a larger amount if you wish. After that, you will be sent a monthly invoice by email until the credit is fully paid. You can always repay your credit in installments larger than the minimum amount stated on the invoice if you wish.
Credit costs and credit example: MERCHANT'S NAME The online store applies campaign terms, according to which the interest rate on the overdraft is 19.2% expressed as a nominal annual percentage rate and the monthly fee is €2.95 per month (€3.80 on the first invoice). If the granted credit limit is €1,000 and it is used in full MERCHANT'S NAME for purchases made in the online store and the credit is repaid over 36 months, with the applicable campaign terms the effective annual interest rate is 28.6%, the total credit costs are €403, the total amount to be paid is €1,403 and the number of payment installments is 36. Late payments will be charged statutory reminder fees and collection costs, as well as interest for the delayed period.

10. Delivery terms
- We will prepare the photos within 1-2 working days of ordering.
- Image products, depending on the product/quantity, take 2-14 working days.
- Foto Karelia Oy delivers photographs and other photo products to the customer by post to Finnish addresses or by collection from our store at Kaivokatu 5, 53100 Lappeenranta, depending on the order method.
- Cancellation of the order is not possible after confirmation of the order, as the contract concerns goods that are manufactured or modified according to the customer's requirements or clearly to meet personal needs. The condition restricting the right to cancel the order is in accordance with Section 16 of the Consumer Protection Act (30.12.2013/1211).
- The 14-day return policy does not apply to custom-made products, such as photographs and photo products. The customer pays for the return themselves. Please contact us before returning at info@fotokarelia.fi or call 010 274 3820.
- If a manufacturing defect is detected in the product, we will replace the product with a new one free of charge or refund the money to the payment method used for the order. The defective product must always be returned to us. Please contact us before returning it.
- Shipping and packaging costs are determined by the weight of the products in the order.

11. Registration
- You can order products without registering or creating a customer account.
- Customer account must be filled in with real name and customer information. The advantage of registration is that you can save your order and continue placing the order later.
-By creating a customer account, you consent to Foto Karelia Oy registering your personal data in the customer register. Your information is confidential, and we do not disclose customer data to third parties other than the information necessary for the delivery of the order (e.g. Posti or payment service provider). The register is maintained by the image service provider Fit Engineerings srl
- You can also place an order without registering, in which case we will only ask for basic information to deliver the order.
3. Removal of your personal data from the register. You can withdraw your consent to the processing of your data at any time. The user has the right to check their data and request that their personal data be corrected or deleted by sending an email to the data controller.
